Introduction
SHEAYAR respects intellectual property rights and expects website users to do the same. This page describes how copyright holders or their authorized representatives may report material they believe infringes their rights.
The website is available at https://sheayar.com/. Copyright-related concerns may be sent to salam@sheayar.com.
SHEAYAR is accessible from many countries, but that does not mean it is legally subject to every provision of United States copyright law solely because it is accessible online. Formal DMCA procedures apply where relevant and applicable. Other copyright requests may be reviewed under the laws and procedures relevant to the circumstances — which may not be the DMCA.
This page distinguishes between a general copyright complaint and a formal DMCA notice. The two are not always the same thing, and the processes that apply to them may differ.
What Is the DMCA?
The Digital Millennium Copyright Act — commonly called the DMCA — is a United States law that includes procedures for handling certain online copyright infringement claims. It is one part of a broader legal framework, and it is not the only mechanism for reporting copyright concerns.
A formal DMCA notice generally needs to contain specific information and meet applicable legal requirements — such as those described in 17 U.S.C. § 512(c)(3) where the statutory procedure applies. A counter-notification is a formal response that may be available to a person whose material has been removed or disabled following a copyright complaint, under conditions described in 17 U.S.C. § 512(g)(3).
A DMCA notice is not simply a general request to remove material someone dislikes. It is a specific legal procedure with information and accuracy requirements. This policy uses plain language to explain how SHEAYAR handles copyright reports, while encouraging rights holders to review the actual statutory requirements before submitting a formal notice.
DMCA Is One Path, Not the Only Path
Not every website, country, or copyright dispute is governed by the DMCA. SHEAYAR accepts general copyright requests as well as formal notices, and reviews each report under the circumstances that apply.
Scope of This Policy
This policy covers copyright complaints concerning content published on SHEAYAR, to the extent the relevant content is hosted, controlled, or made available by the website. Potential content categories may include:
- Poetry and Shayari;
- Literary articles and essays;
- Quotations and excerpts;
- Translations or adaptations;
- Poetry images and graphics;
- Other creative material.
These examples do not mean that SHEAYAR owns every work or hosts every type of content. Rights and ownership vary work by work.
Complaints about third-party websites should normally be sent to the relevant website operator or service provider, because SHEAYAR cannot directly remove content from websites it does not control.
Copyright Ownership and Literary Content
Copyright ownership depends on the specific work, its author, any applicable license, and the relevant law. Reasonable people and reasonable rights holders may disagree about these details, which is one reason a careful review process matters.
In general terms:
- Original literary works may have copyright protection.
- Photographs and original graphics may have separate rights holders.
- Translations and adaptations may involve rights distinct from the underlying work.
- Some works may be in the public domain.
- Some content may be used under a license or a legal exception.
- Attribution alone does not automatically grant permission to reproduce copyrighted material.
SHEAYAR does not claim ownership of every poem, quotation, image, or literary work published on the website. Similarly, the website does not assume that a work is copyrighted or in the public domain without appropriate evidence. Each notice is reviewed on its own facts.
How to Submit a Copyright Complaint
A person who believes their copyrighted work has been used unlawfully may contact SHEAYAR. Clear and complete information helps the team understand the concern and locate the material.
In general, a good copyright complaint identifies the allegedly infringing content and provides enough information to locate and review it. Recommended details include:
- The complainant's full legal name;
- A working email address;
- The name or description of the copyrighted work;
- A description of the rights being asserted;
- The exact URL of the allegedly infringing page;
- The exact location of the material on the page, if possible;
- An explanation of why the use is believed to be unauthorized;
- Evidence of ownership or authority to act, where appropriate.
A general copyright complaint does not need to contain every formal DMCA element described in Section 06. That section describes the additional information ordinarily required for a formal statutory notice — a different, more specific submission.
Required Information for a Formal DMCA Notice
Where the formal statutory procedure under 17 U.S.C. § 512(c)(3) applies, a valid notice ordinarily includes the following information. SHEAYAR reviews formal notices against the applicable statutory requirements.
Formal DMCA Notice — Required Elements
- Identification of the copyrighted work — the work you believe is being infringed. If multiple works are involved, a representative list may be provided where the law permits.
- Identification of the allegedly infringing material — the specific URL or other sufficiently detailed information to help locate the material on SHEAYAR.
- Contact information — information sufficient for the website team to contact you, such as an address, telephone number, and email address, as required by the applicable statutory procedure.
- Good-faith statement — a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Accuracy and authority statement — a statement that the information in the notice is accurate and, under penalty of perjury where required, that you are authorized to act on behalf of the owner of an exclusive right allegedly infringed.
- Signature — a physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf, as required by the applicable procedure.
Incomplete notices may require clarification and may not qualify as valid formal notices. This section describes the general statutory elements but does not replace the official text of the statute. A simple email will not necessarily satisfy every formal legal requirement, and rights holders should review the statute or seek independent legal advice when submitting a formal notice.
Where to Send a Copyright Complaint
Copyright complaints and general copyright concerns may be sent to the following verified contact:
- Copyright email: salam@sheayar.com
Use a clear subject line — for example, "Copyright Infringement Notice" — and include the relevant URLs and supporting information in the body of the message.
The WhatsApp number +92 345 1812279 is available as an additional general contact channel for initial enquiries. However, formal statutory notices may require information beyond a WhatsApp message and should be sent through the email channel described above.
SHEAYAR does not currently publish a separate registered DMCA agent or a dedicated postal address for copyright notices. If the website owner later registers a designated agent, or publishes a postal address, that information will be added to this page.
What Happens After a Complaint?
When a copyright complaint is received, SHEAYAR follows a general review process. The exact steps depend on the nature of the report and the available information.
- The website receives the complaint.
- The team checks whether the report identifies the content and explains the alleged infringement.
- Additional information may be requested if the report is unclear or incomplete.
- Where appropriate, the website may remove or disable access to material, contact the relevant parties, or take another action permitted by law.
- The outcome may depend on the available evidence and applicable legal requirements.
Receipt of a complaint does not guarantee immediate removal. Every complaint is reviewed on its own facts, and SHEAYAR does not automatically accept every complaint as valid. Where a report is clear and complete, the review process is usually faster.
Counter-Notification Process
A counter-notification may be available under the DMCA when material has been removed or disabled because of a formal copyright notice, and the affected person believes the removal resulted from a mistake or misidentification.
A formal counter-notification under 17 U.S.C. § 512(g)(3), where applicable, generally includes:
- Identification of the material that was removed or disabled and its previous location;
- A statement under penalty of perjury that the person has a good-faith belief that the material was removed or disabled because of mistake or misidentification;
- The person's name, address, and telephone number;
- Consent to the jurisdiction of the appropriate United States federal district court under the conditions specified by the statute;
- Agreement to accept service of process from the original complainant or their authorized representative;
- A physical or electronic signature.
Legal Consequences of Counter-Notification
Submitting a counter-notification can have legal consequences and may involve sharing relevant information with the original complainant. The precise statutory requirements and jurisdictional conditions should be checked before a formal counter-notification is submitted. Not every affected person automatically qualifies to submit a valid counter-notification.
Restoration of Removed Material
Where the DMCA counter-notification procedure applies, restoration of removed or disabled material may depend on statutory conditions and timelines.
In general terms — and this is a general description of the statutory procedure, not a promise that SHEAYAR will restore every item within a fixed time — after a qualifying counter-notification is received, a service provider following the relevant procedure may restore the material between 10 and 14 business days after receiving the counter-notification, unless the designated agent receives notice from the original complainant that a court action has been filed seeking to restrain the allegedly infringing activity.
Restoration therefore depends on the circumstances, the legal requirements, and whether the relevant procedure applies. SHEAYAR does not promise restoration where the legal conditions have not been met.
Repeat Infringement
Where applicable and appropriate, SHEAYAR may take reasonable measures against repeat infringement. Examples may include removing repeatedly infringing material, restricting relevant submission privileges, or terminating access where a genuine user account or submission feature exists.
If the website does not currently support user accounts or public user submissions, account termination is not an active feature of the website. Any repeat-infringer process is expected to be consistent with applicable law and with the website's actual capabilities.
SHEAYAR does not claim that a formal repeat-infringer program has been published beyond the description in this section unless that program is separately documented.
False or Incomplete Claims
Copyright notices and counter-notifications should be accurate, made in good faith, and submitted by people with an appropriate legal basis. Accuracy matters both for the person submitting the complaint and for the person whose material is being reviewed.
Knowingly making material misrepresentations in certain formal DMCA notices or counter-notifications can create legal liability under applicable law, including potential liability under 17 U.S.C. § 512(f). This is a legal consequence that applies to false statements — it is not a general suggestion that every unsuccessful complaint is fraudulent.
SHEAYAR may request clarification or decline to act on a report that lacks sufficient information, subject to applicable law. If you are unsure whether your concern qualifies as a formal notice, you are welcome to contact the team first with a general enquiry.
Third-Party Content and External Links
SHEAYAR may refer visitors to external websites or resources. These links are provided for convenience and do not imply that SHEAYAR operates, controls, or endorses the external website.
SHEAYAR cannot directly remove content from websites it does not control. Where the allegedly infringing material is located on a third-party website, copyright holders should contact the relevant third-party website, hosting provider, or platform directly.
External platforms have their own copyright procedures, which are separate from the process described in this policy. SHEAYAR does not control external platforms or their copyright procedures.
General Copyright Requests Outside the DMCA
People may contact SHEAYAR about copyright or attribution concerns even when they are not submitting a formal DMCA notice. Examples include:
- Incorrect author attribution;
- Suspected unauthorized reproduction;
- Requests to review a disputed quotation or image;
- Questions about a license or permission.
These requests are reviewed under the relevant circumstances and applicable law. A general copyright request is not necessarily a formal statutory DMCA notice, and it does not automatically trigger the statutory counter-notification process. SHEAYAR may still take appropriate action where a general request identifies a genuine concern.
Policy Updates
SHEAYAR may update this DMCA Policy when its publishing practices, website features, or legal requirements change. The current version of the policy is the one published on this page, and it replaces any earlier version.
Visitors are encouraged to review this policy periodically so that they are aware of the current reporting process and the contact details in effect.
SHEAYAR does not operate an individual email-notification system for every revision unless such a system is explicitly stated as active.
Contact Information
Copyright reports should contain sufficient details to identify the material and the rights being asserted. The following verified contact information is available for copyright-related enquiries:
- Website: https://sheayar.com/
- Copyright email: salam@sheayar.com
- WhatsApp: +92 345 1812279
- Phone: +92 345 1812279
- Founder: Engr. Muhammad Afzal Khan
The founder is identified for the purpose of general enquiries only. Neither the founder nor any member of the SHEAYAR team is presented on this page as a lawyer or a registered DMCA agent. Contacting the team does not create a lawyer-client relationship and does not guarantee a specific response time.
Before You Submit a Copyright Notice
Providing clear information helps the SHEAYAR team understand your concern and locate the material you want reviewed. A well-prepared submission is more likely to receive a clear and timely response.
- Identify the original copyrighted work.
- Provide the exact URL of the disputed material.
- Explain why you believe the use is unauthorized.
- Include accurate contact details.
- Provide the required statements and signature for a formal DMCA notice, where applicable.
How Copyright Reports Are Reviewed
Four clear stages from initial identification to final follow-up.
Identify
The complainant identifies the original work and the material in question.
Submit
The complainant sends the relevant URLs, explanation, and required contact details.
Review
The website team reviews the information and may request clarification or take an appropriate action.
Follow Up
The complainant may be contacted for further information or an update where appropriate.
Attribution and Permission Are Different
Identifying an author or providing a credit does not automatically grant permission to reproduce a copyrighted work. Attribution is good practice — but it is not a substitute for permission where permission is legally required.
Before reusing material, check the relevant license, obtain permission where required, or determine whether a legal exception applies to your specific use.
Important Notice
The DMCA is a United States law, and its formal procedures may not apply identically to every dispute or jurisdiction. Different countries have different copyright frameworks, and different websites have different reporting processes.
This page provides general information about SHEAYAR's copyright-reporting process. It is not legal advice. Copyright holders who are uncertain about their rights, about the requirements for a formal notice, or about the applicability of DMCA procedures to their situation should consider seeking independent legal advice.
SHEAYAR is not a law firm and does not provide legal representation. Nothing on this page should be read as a promise of a particular legal outcome or a guarantee of specific results.
